歡迎使用 Kernel！這份文件包含《服務條款》與《隱私權政策》，說明了使用 Kernel 網站及 iOS App 時的規範，以及我們如何收集與使用你的資料。Kernel 是一款專為台灣高中生打造的多人英文學習應用程式，旨在透過間隔重複演算法與遊戲化機制，協助你準備學測。使用本服務，即代表你同意以下條款。
第一部分：服務條款 (Terms of Service)
1. 接受條款與修改
當你下載、存取或使用 Kernel 時，即表示你同意受本條款約束。我們可能會隨時更新本條款，重大變更將透過 App 或網站通知你。繼續使用即代表你接受修改後的內容。
2. 服務使用與帳號安全
- 雖然你可以不登入就使用部分 Kernel 功能，但若選擇建立帳號，你必須妥善保管帳號與登入資訊，並對你帳號下的所有活動負責。
- 發現任何未經授權的帳號登入情況，請立即通知我們。
3. 內容與智慧財產權
- 本服務的平台設計、程式碼、寵物美術素材及 FSRS 記憶演算法之所有權均歸 Kernel Tech 所有。
- 依據台灣著作權法第 9 條第 1 項第 5 款，學測、指考、分科測驗等依法令舉行之考試試題及備用試題，不屬於著作權保護的標的，任何人均可自由利用與重製。Kernel 所使用的歷屆考題素材係依此規定合法引用。惟考題之參考解答若具備原創性，仍可能受著作權法保護。
- 你保留個人社交動態與個人資料的所有權，並授權我們在 App 內向你選擇的好友展示這些內容。
4. 免責聲明（重要事項）
- 學習成效免責：Kernel 是一款協助你記憶單字的輔助工具。我們努力提供最佳的學習演算法，但不保證使用本服務能確保你達成特定的學測成績或考試結果。
- 本服務按「現況（As is）」提供，我們不對服務的完全無中斷或無錯誤做出擔保。我們對任何間接、附帶或衍生性損害不承擔法律責任。
5. 行為規範與帳號終止
請保持社群友善，禁止惡意騷擾他人。我們嚴禁利用系統漏洞竄改學習數據、金幣或寵物狀態。若有嚴重違規行為，Kernel 有權在不另行通知的情況下，暫停或永久刪除你的帳號。
6. 準據法
本條款受中華民國（台灣）法律管轄。
第二部分：隱私權政策 (Privacy Policy)
這份政策說明我們在你使用網站和 iOS App 時會收集哪些資料，以及我們如何使用這些資料。
1. 我們收集的資訊
透過網站收集的資訊：
- 候補名單資訊：你加入候補名單時提供的電子郵件地址。
- 網站分析：透過 Vercel Analytics 收集的頁面效能指標（Core Web Vitals）、瀏覽次數、來源網頁及瀏覽器/系統資訊。（此功能不使用 Cookie，也不做個人身分識別）。
- 本機偏好：儲存在瀏覽器本機儲存空間（Local Storage）中的語言偏好設定（此資料不會離開你的裝置）。
- 字型載入：載入字型時發送至 Google 的標準 HTTP 請求資料（Google Fonts）。
透過 iOS 應用程式收集的資訊：
- 帳戶資訊：透過 Google 登入（OAuth 2.0）取得的顯示名稱、大頭貼網址和 Email。（登入非強制，你也可以在不登入的狀態下使用 Kernel）。
- 學習資料：練習紀錄、答對/答錯狀況、每題作答時間、間隔重複狀態（FSRS 參數）、複習紀錄和每日活動。
- 寵物與遊戲資料：XP（經驗值）、連續學習天數、金幣餘額、寵物開心度/飢餓度、寵物種類、配色、名字、已解鎖裝扮和金幣交易紀錄。
- 社交資料：好友連結、好友代碼、上線/學習中/離線狀態，以及社交動態。
- 偏好設定：考試類型、目標考試日期、每日單字目標、年級、難度設定和每日複習上限。
- 裝置資訊：Apple 推播通知服務（APNS）權杖和平台資訊（僅用來發送推播通知）。
- 分析事件：透過 PostHog 收集的登入和 App 開啟事件（綁定匿名 ID）。
- 裝置本機儲存：寵物狀態、學習進度、單字快取、測驗狀態和活動日期會存在你手機的 UserDefaults 裡，供離線使用和主畫面小工具（Widget）讀取。
我們「不」收集的資訊：
我們絕對不會取用你的相機、麥克風、GPS 位置、聯絡人、健康資料或手機相簿照片。
2. 我們如何使用你的資訊
- 營運和改善 Kernel 的核心功能。
- 根據你的記憶狀態（FSRS 參數）精準安排單字複習時間。
- 支援社交功能，讓你加好友、查看彼此的學習狀態。
- 發送學習提醒推播和好友動態通知。
- 處理候補名單，並在產品上線時通知你。
- 了解使用者的 App 操作習慣，以持續優化體驗。
- 防止系統濫用和未經授權的存取。
3. 第三方服務
我們使用以下受信任的服務來營運 Kernel：
- Supabase：我們的資料庫。儲存你的帳戶、學習進度、好友和寵物資料。
- Google 登入：處理登入流程，使用 OAuth 權杖驗證你的身分。
- PostHog：產品分析工具。接收匿名使用事件（如登入、App 開啟）。
- Apple 推播通知服務 (APNS)：負責發送推播通知到你的裝置。
- Vercel Analytics（僅限網站）：監測頁面效能指標（無 Cookie，無個人識別）。
- Web3Forms（僅限網站）：處理候補名單的 Email 提交。
- Google Fonts（僅限網站）：提供網頁字型檔案。
4. 資料儲存與安全
你的資料儲存於 Supabase，資料庫的每張表都設有列級安全性（Row Level Security, RLS），確保你只能存取自己的資料。此外，XP、金幣和連續天數等遊戲數據皆由伺服器端進行驗證，無法從 App 端竄改。所有的資料傳輸皆透過 HTTPS 加密進行。
5. 資料保留與刪除
- 保留期限：帳戶和學習資料將在你保留帳戶期間持續儲存（間隔重複演算法需要你的完整歷史紀錄才能正常運作）。候補名單的 Email 將保留至產品正式上線，或直到你要求移除為止。
- 刪除資料：你可以隨時透過 App 內的「設定」選擇「刪除帳號」，或透過第 10 節的聯絡方式聯繫我們。帳戶刪除後，你的個人資料會從我們的伺服器上永久移除。
6. 兒童隱私
Kernel 主要為高中生（約 15–18 歲）設計。我們不會故意收集未滿 13 歲（或歐盟地區未滿 16 歲）兒童的個人資料。如果你未達此年齡門檻，請務必在家長或法定監護人的同意下使用。若我們發現不小心收集了未達法定年齡使用者的資料，將會立即刪除。如有此類情況，請主動告知我們。
7. 你的權利
根據你所在地區的法律（包括台灣《個人資料保護法》及歐盟 GDPR），你擁有以下權利：
- 查看我們持有你的哪些個人資料。
- 更正錯誤或不完整的資料。
- 要求我們刪除你的資料。
- 限制或反對我們處理你的資料。
- 取得你的資料副本（可攜式格式）。
- 隨時撤回你對資料處理的同意。
如需行使以上權利，請透過第 10 節的聯絡方式與我們聯繫。
8. 國際資料傳輸
為提供服務，你的資料可能會儲存並處理於你所在國家以外的伺服器上（依賴 Supabase 的基礎設施）。使用 Kernel 即代表你了解並同意此項跨境資料傳輸。
9. 政策變更
本隱私權政策可能會隨時更新。如果有重大變更，我們將透過 App 或網站向你發送通知。

Kernel Terms of Service & Privacy Policy

Welcome to Kernel. This document combines our Terms of Service and Privacy Policy, explaining the rules for using the Kernel website and iOS app, and how we collect and use your information. Kernel is a social English study product designed for Taiwanese high school students, using spaced repetition and gamification to support study for the General Scholastic Ability Test. By using Kernel, you agree to the terms below.
Part 1: Terms of Service
1. Acceptance & Changes
By downloading, accessing, or using Kernel, you agree to be bound by these Terms. We may update these Terms at any time, and we will notify you of material changes through the app or website. Continued use means you accept the updated version.
2. Account Use & Security
- Some Kernel features may be used without logging in, but if you choose to create an account, you must keep your account credentials secure and remain responsible for all activity under your account.
- If you suspect unauthorized access to your account, please contact us right away.
3. Content & Intellectual Property
- All rights in the platform design, code, pet artwork, and FSRS memory engine belong to Kernel Tech.
- Under Taiwan’s Copyright Act Article 9, Paragraph 1, Item 5, exam questions and substitute questions for law-regulated examinations such as the University Entrance Exam, Subject Achievement Test, and Joint Entrance Exam are not protected by copyright and may be freely used or reproduced. Kernel’s use of past exam questions follows that rule. However, official explanatory answers may still be protected if they contain original expression.
- You keep ownership of your social posts and profile data and grant Kernel permission to display those materials to your selected friends within the app.
4. Disclaimers
- Learning outcomes disclaimer: Kernel is a vocabulary study support tool. While we strive to provide the best learning algorithm, we do not guarantee that using Kernel will guarantee specific exam scores or outcomes.
- The service is provided on an "as is" basis. We do not warrant that the service will be uninterrupted or free from errors. We are not liable for indirect, incidental, or consequential damages.
Part 2: Privacy Policy
This section explains what data we collect while you use our website and iOS app, and how we use that data.
1. Information We Collect
Information collected via our website:
- Waitlist information: Email address provided when joining the waitlist.
- Site analytics: Page performance metrics (Core Web Vitals), page views, referrers, and browser/OS information collected through Vercel Analytics. (No cookies and no personal identification.)
- Local preference: Language preference stored in browser Local Storage (data never leaves your device).
- Font loading: Standard HTTP requests sent to Google when loading web fonts.
Information collected in the iOS app:
- Account information: Display name, avatar URL, and email obtained via Google Sign-In (OAuth 2.0). Sign-in is optional, and you may use Kernel without an account.
- Learning data: Practice logs, correct/incorrect answers, time per question, spaced repetition status (FSRS parameters), review history, and daily activity.
- Pet and game data: XP, study streak, coin balance, pet happiness/hunger levels, pet type, color theme, pet name, unlocked outfits, and coin transaction history.
- Social data: Friend links, friend codes, online/learning/offline status, and social feed activity.
- Preferences: Exam type, target exam date, daily vocabulary target, grade level, difficulty settings, and daily review limit.
- Device data: APNs token and platform details used only for push notifications.
- Analytics events: Login and app-open events collected through PostHog and tied to an anonymous ID.
- On-device storage: Pet status, learning progress, vocabulary cache, quiz state, and activity dates are stored in your phone’s UserDefaults for offline use and widget reading.
Information we do not collect:
We do not access your camera, microphone, GPS location, contacts, health data, or photos.
2. How We Use Your Information
- Operate and improve core Kernel features.
- Schedule vocabulary reviews based on your memory state (FSRS parameters).
- Support social features so you can add friends and check learning status.
- Send study reminders and social activity push notifications.
- Process the waitlist and send launch notifications.
- Analyze app usage patterns to continuously optimize the experience.
- Prevent abuse and unauthorized access.
3. Third Parties
We use trusted service providers to operate Kernel:
- Supabase: Our database, storing account data, learning progress, friends, and pets.
- Google Sign-In: Handles authentication flow with OAuth tokens.
- PostHog: Product analytics for anonymous events such as login and app opens.
- Apple Push Notification Service (APNS): Sends push notifications to your device.
- Vercel Analytics (website only): Tracks site performance metrics with no cookies and no personal IDs.
- Web3Forms (website only): Handles email submissions for the waitlist.
- Google Fonts (website only): Provides web font files.
4. Storage & Security
Your data is stored in Supabase, where each table uses Row Level Security (RLS) so you can only access your own data. XP, coins, and streaks are also validated on the server side and cannot be tampered with from the app client. All data transfer is encrypted over HTTPS.
5. Retention & Deletion
- Retention period: Account and learning records are retained while your account exists, as the spaced repetition engine requires complete history to function correctly. Waitlist emails are kept until launch or until you request removal.
- Deleting your data: You can delete your account any time from Settings inside the app or contact us via Section 10. Once an account is deleted, your personal data is permanently removed from our servers.
6. Children's Privacy
Kernel is designed primarily for high school students (approximately 15–18 years old). We do not knowingly collect personal data from children under 13, or under 16 in the European Economic Area. If you are below these thresholds, you must use Kernel with parental or guardian consent. If we discover data from underage users was collected, we will remove it promptly. Please let us know if this applies to you.
7. Your Rights
Depending on your location (including Taiwan's Personal Data Protection Act and the EU GDPR), you have the following rights:
- Request access to personal data we hold about you.
- Request correction of inaccurate or incomplete data.
- Request deletion of your data.
- Restrict or object to our data processing.
- Receive a copy of your data in a portable format.
- Withdraw consent for processing at any time.
To exercise these rights, contact us using the details in Section 10.
8. International Transfers
Your data may be stored and processed on servers outside your country (through Supabase infrastructure). By using Kernel, you understand and agree to this cross-border transfer.
9. Policy Changes
We may update this Privacy Policy at any time. Material changes will be notified through the app or website.
